Homo ontmoetingsplaatsen hebben bestaansrecht
Inleiding
Het fenomeen HOP(Homo ontmoetingsplaatsen) is niet iets van de laatste tijd, maar van alle tijden. (het Haagse Bos wordt in historisch perspectief vaak genoemd)De HOP vormt daarmee een onmiskenbaar onderdeel van de homocultuur waar mannen contact zoeken op veel plaatsen zowel binnen als buiten de landsgrenzen, overal ter wereld.
Homo ontmoetingsplaatsen hebben bestaansrecht, zijn niet illegaal en moeten met rust gelaten worden•
Ontmoeding en ontmanteling van HOP, s is zinloos vanwege ongewenste verplaatsingseffecten (Waterbedeffect)
De grens van onderdrukking is bereikt en dat moet stoppen.
Wat is onze visie over HOP, s
Stichting platform Keelbos is de organisatie die de belangen van de HOPbezoekers behartigt,
Aan homo ontmoetingsplaatsen bestaat een duidelijke behoefte voor een minderheid van mannen met homoseksuele gevoelens, waar ze op hun manier uiting kunnen geven aan intieme gevoelens en het hebben van seksueel contact .
Veel mannen kunnen om privacy redenen niet thuis ontvangen of durven dat niet vanwege mogelijke homofobe reacties vanuit hun sociale omgeving of het verschijnsel van “niet uit de kast durven komen”
Voor sommigen is een dergelijk plek ook nodig om sociale contacten te kunnen onderhouden, dus een vorm van socializing. bovendien voorziet een ontmoetingsplaats in een veilige sociale omgeving en biedt enige weerbaarheid en bescherming tegen kwaadwillenden.
Deze ontmoetingen hebben ook een recreatief karakter, vooral in de zomermaanden, waarbij sprake is van een zeker spanningselement waarbij betrokken zich behaaglijk voelen.
Bezoekers van de HOP worden beschermd door grondrechten( Nederlandse grondwet, zelfbeschikkingsrecht) en mensenrechten, zoals gewaarborgd door het Europese Verdrag tot bescherming van de Rechten van de Mens en de fundamentele vrijheden (EVRM). Vooral gaat het dan om het recht van een ieder op respect voor zijn privé-leven (art. 8 EVRM; art. 10 Grondwet) en op vrijheid van vreedzame vergadering (art. 11 EVRM; art. 9 Grondwet). Ook kan sprake zijn van het openbaren van gevoelens.
Doordat seksuele contacten plaatsvinden in de beschutting van bossages, is sprake van een privé-sfeer binnen de openbare ruimte, waarbinnen het recht op privé-leven kan worden uitgeoefend. De privé-sfeer beperkt zich immers niet tot de eigen woning, maar het gaat om een veel ruimer begrip. Bepaalde gewoonten, gedragingen en contacten kunnen eveneens tot de privé-sfeer worden gerekend (Dr G.J.M. van Wissen, Grondrechten, 1992, Hoofdstuk 6 Het recht op eerbiediging van de persoonlijke levenssfeer, p. 113, alwaar genoemde auteur Akkermans citeert). Waar twee of meer mensen samenkomen, is sprake van uitoefening van het recht van vergadering of samenkomst
Niet omstreden is dat intiem contact, al dan niet gepaard gaand met seksueel, contact als zodanig niet onrechtmatig is, maar dat slechts de uitstralingseffecten (vermeende overlast) als onwenselijk worden ervaren. Het volledig belemmeren van de uitoefening van genoemde mensenrechten zijn dan ook disproportioneel, die niet kan worden gebaseerd op de bij het EVRM voorziene beperkingclausules betreffende deze grondrechten. Uitsluitend flankerend beleid, waarbij de hindereffecten worden ingedamd maar waarbij het gebruik als zodanig niet wezenlijk wordt aangetast, heeft een voldoende juridische basis.
Wat is de stand van zaken m.b.t. HOP, s en wat gebeurt er in de praktijk
Vooropgesteld vinden wij dat klagers te veel gehoor krijgen bij gemeenten en andere instanties,
HOP, s blijven helaas een omstreden verschijnsel en roepen voortdurend spanningen op tussen bezoekers en omwonenden en andere recreanten
In de publieke opinie is er veel afkeuring over dit soort plaatsen,meestal op morele gronden.,maar ook vanwege irreële angsten. en onwetendheid . Het past niet meer in deze tijd is een algemene opvatting.
Enkele opvattingen:
“ seks moet je maar thuis doen en hetero, s doen het ook niet in de openbare ruimte. het is onbetamelijk, homo’s denken meer rechten te hebben. en voelen zich snel gediscrimineerd. prima dat homo, s uit de kast komen, maar ze moeten ook uit het bos blijven.”
Uit onderzoek blijkt overigens dat een/derde van de bevolking er geen problemen mee heeft.
Ook is men bang voor verstoringen in gezinssituaties omdat er ook getrouwde mannen komen en dat meet men weer af aan geparkeerde auto, s met kinderzitjes, maar wat zegt dat nou? helemaal niet zoveel.
Vertrouwen hebben in eigen verantwoordelijkheid is een beter uitgangspunt, en dat geldt ook voor veilig vrijen.
Alleen al de wetenschap, dat er zo, n plek bestaat kan al beelden van afschuw oproepen, zonder dat er ook maar iets is waar te nemen. De meeste klachten zijn gebaseerd op van “horen zeggen” en van mensen die er nooit komen.
Weggegooid afval, waar men naar op zoek gaat en wat wordt uitvergroot is vaak het belangrijkste argument om een HOP op te doeken. dit is echter een non argument, want er is sprake van veel ander afval en is voor een groot deel op te lossen door het plaatsen van prullenbakken en het op gezette tijden inzetten van een schoonmaakploeg.
Eigenlijk wil men af van deze ontmoetingsplaatsen op grond van het “Gesundes Volksempfinden” en homofobe denkpatronen . er is geen plaats meer voor diversiteit, want dat is alleen maar lastig om rekening te moeten houden met elkaar.
Het verschijnsel HOP moet daarom gedenormaliseerd worden, vindt men en soms wordt zelfs gedragstherapie voorgesteld, of andere vormen van gedragsbeïnvloeding.
Waar blijft uw zelfbeschikkingsrecht?
Het is opmerkelijk dat, die plekken waar er nauwelijks overlast is en meer afgelegen zijn, ver buiten de bebouwde kom, ook onder vuur liggen.
Een sprekend voorbeeld is de ontmoetingsplaats in het natuurgebied Ruyven in de gemeente Pijnacker Nootdorp, maar er zijn vele soortgelijke situaties, bijvoorbeeld in de omgeving van Haarlem., en plekken in Noord Brabant, Limburg Groningen en Gelderland.
Overlast is vaak een gezocht argument,;waar het werkelijk om gaat bij ontmoedigingsbeleid en
sluitingspogingen zijn moraliteitsopvattingen ,sentimenten , homo,s moeten voldoen aan de heteronorm en het egoïstische “ Not In My Backyard principe “.
Het lijkt erop dat deze ontwikkelingen een gevolg zijn van het huidige tijdsbeeld waarin we steeds minder verdragen en de intolerantie toeneemt en dat geldt evenzeer voor andere minderheidsgroepen (u kunt zelf voorbeelden bedenken) . een bekend gevolg is de toenemende intolerantie en geweldplegingen tegen homoseksuelen.
we stevenen af op een uniforme maakbare samenleving, die goed te controleren zou zijn, maar tegelijkertijd een enorme valkuil inhoudt, wat betreft het inleveren van verworven vrijheden. kijk maar om u heen!
Uitvoeren van verstoringacties en nemen van buitenproportionele maatregelen
Het buitenproportionele karakter van de maatregelen die lokale overheden maar ook instanties zoals RWS en recreatieschappen, voorstellen en uitvoeren om homo–ontmoetingsplaatsen. te ontmoedigen of onmogelijk te maken.
het valt niet goed te verklaren dat deze overheden zich zo expliciet richten op het fenomeen HOP en daar veel ambtelijke uren, en dus gemeenschapsgeld, in stoppen, terwijl het Platform uit navraag bij het Openbaar Ministerie binnen diverse arrondissementen en bij korpsdirecties van de politie in Nederland gebleken is dat nauwelijks sprake is van aantoonbare overlast en al helemaal niet van strafbare feiten op en bij de HOP. enkele excessen van randfiguren daargelaten.
Enkele beruchte maatregelen:
• het buitensporig snoeien van bossages tot en met volledige kaalkap .
• hermetisch afsluiten door het plaatsen van hekken.
• afsluiten van parkeerplaatsen of de toegang verhinderen door het plaatsen van slagbomen met pasjessystemen.
• het graven van brede sloten
• het inzetten van Schotse Hooglanders.(rundvee)
• pogingen ondernemen om via Algemeen Plaatselijke Verordeningen met dubieuze strafbepalingen het cruisen strafbaar te stellen en dat op borden kenbaar te maken.
• gerichte opsporing van mannen die elkaar ontmoeten, buiten art 239 Wsr (daadwerkelijke schennispleging) om, door BOA, s en de politie.
Een recent voorbeeld is een razzia -achtige actie, afgelopen mei, door de politie op twee HOP, s aan de A58 bij Tilburg om 11 uur s, avonds. De zaak is nog in onderzoek,want de politie is slechts uitvoerder, maar de burgemeester van Tilburg heeft al laten weten: “Dat was eens maar nooit meer!.”
Het is kennelijk makkelijk scoren, wat betreft homo-ontmoetingsplaatsen. Populisme en incidentenpolitiek vormen de laakbare achtergrond van dergelijk repressief overheidsoptreden. In verband met privacy, kwetsbaarheid en chantabiliteit valt er niet veel weerstand te verwachten van onze doelgroep;
Homo discriminatie, in verband met deze maatregelen, wordt stelselmatig tegengesproken Het veelal gebezigde antwoord van deze overheden en de politie is, dat men met nadruk wil stellen dat men zich niet richt op homoseksuele mannen, maar dat men overlast als een generiek verschijnsel wil duiden, terwijl men, op een ander moment, gebruik makend van de megafoonfunctie van de media, wel degelijk de anti-homo-opvattingen heeft laten blijken.
Ongewenste gevolgen
Bezoekers van ontmoetingsplaatsen zijn regelmatig slachtoffer van anti-homogeweld (potenrammerij) en intimidatie . Hoewel overheden en omwonenden zich steeds meer bewust worden van dit fenomeen, is er nog onvoldoende besef van de oorzakelijkheid tussen repressief overheidsoptreden tegen HOP’s en door overheden gevoede negatieve media-aandacht, en het ontstaan van misdrijven jegens homo- en biseksuelen. Door ontmoedigingsmaatregelen die leiden tot geweldsmisdrijven wordt de HOP-bezoeker tot dader en tot slachtoffer gemaakt, wat hem stigmatiseert en ook in zijn eigen beleving extra kwetsbaar maakt. nog afgezien van de gezondheidsklachten,zoals angststoornissen, die betrokkenen kunnen ontwikkelen.Als gecriminaliseerd individu twijfelt de HOP-bezoeker er immers aan, of de sterke arm van politie en justitie wel voor hem zal opkomen waar dat nodig is.Dan is er nog het aspect van gezondheidswetgeving.Een Hop is goed vindbaar en bereikbaar voor medewerkers van de GGD, zodat ze hun voorlichting- en preventietaken adequaat kunnen uitoefenen.
Het is gebleken, dat er van deze taakuitoefening niet veel meer overblijft door dat ontmoedigingsklimaat.
welke oplossingen zijn er en wat willen we m.b.t. HOP, s bereiken.
Binnen het Rijk, Provincie, gemeenten.en andere overheden is een duidelijke afschuiving van verantwoordelijkheden met betrekking tot de HOP-problematiek te zien.
Er gaapt een te groot gat tussen de centrale en de lokale overheid, het macro- en het microniveau. Het mesoniveau is in dat verband van essentieel belang en daar hoort de toezichts- en regiefunctie van de provinciale overheid nadrukkelijk bij, met inbegrip van het regionale collegeoverleg. Lokale overheden en andere bestuurslichamen trekken te veel hun eigen plan, er zijn teveel plaatselijke (morele) belangen en de balans slaat al snel door ten nadele van onze minderheidsgroep .
de indruk bestaat ook dat men het instrument van de Algemene Plaatselijke Verordening – de APV – misbruikt en dat er is niet of nauwelijks sprake is van intergemeentelijke afstemming.
Onder de nieuwe Wet op de Ruimtelijke Ordening (WRO), die per 1 juli jl. in werking is getreden, kan de provincie zelfs een regulerende rol met betrekking tot HOP’s vervullen, nu zij de bevoegdheid krijgt om inpassingplannen, een soort provinciale bestemmingsplannen, kan maken. Aldus kan de provincie aan HOP’s een wettelijke gebruiksstatus toekennen. Wel dient de provincie de HOP dan als een provinciaal belang te erkennen, en als zodanig in beleidsplannen vast te leggen.
We pleiten in eerste instantie om HOP, s ongemoeid te laten en slechts indien er sprake is van hindereffecten om over te gaan tot regulering dmv compartimentering, om confrontatiekansen te verminderen. het aanbrengen van extra voorzieningen en extra toezichthouding en zeker geen opsporingsacties ondernemen
Weer ruimte geven aan zorg- en welzijnswerkers.
Dit allemaal in samenspraak en samenwerking met alle betrokken partijen en zeker de homobelangenorganisaties en zoals eerder bepleit onder regie van de provinciale overheid.
De rol van de politie en andere handhavingsambtenaren.
Elke burger in Nederland heeft recht op een goede politiezorg, zo zetten zij zich in om de veiligheid van bezoekers op HOP,s zeker te stellen door alert te zijn op mogelijke geweldsmisdrijven.
Daarnaast wordt op de politie een beroep gedaan om te reageren op overlastklachten
De politie is professioneel genoeg om daar een goede balans in te vinden en buitenproportionele acties of bejegening achterwege te laten.
Het Landelijk Expertise Centrum Diversiteitenbeleid van de politie heeft richtlijnen opgesteld hoe politieambtenaren dienen te acteren op een HOP en dat heeft met respectvolle benadering te maken (Blauw op de roze ontmoetingsplaats)
Wat kunnen de HOP bezoekers zelf doen
Houdt altijd rekening met andere mensen, die niet betrokken zijn bij de ontmoetingen
Dring je nooit op en zoek altijd voldoende(groen) beschutting ingeval van intiem contact
Denk aan je eigen privacy.
Als het te druk is met andere recreanten, kies een ander tijdstip uit of ga ergens anders naar toe.
Volg eventuele aanwijzingen van toezichthouders op
Laat geen afval achter want dat is de grootste ergenisbron van klagers
Breng je gezondheid niet in gevaar
Wees alert op personen met minder goede bedoelingen, waarschuw elkaar en doe een melding bij de politie.
Zorg voor een netwerkopbouw
Denk ook eens aan weerbaarheid en solidariteit.
Als er sprake is van intimidatie of geweld(dreiging), doe altijd aangifte, desnoods anoniem en meld het bij het COC, ons platform of de DWH.
Maar informeer vooral je lotgenoten, want ze hebben recht op rust en veiligheid.
